In these terms, “we” means this company.
These terms apply only to households in the United States and Canada. They cover the heyshary app, the browser version and the sync service behind them. On iPhone, Apple's Standard End User License Agreement (EULA) continues to apply. These terms supplement it for our service. If they conflict on the licence for the app, Apple's EULA prevails.
heyshary is a family organizer. It helps your household share tasks, appointments and reminders. Reminders and deadlines in heyshary are general information. They are not legal, medical or financial advice. They may be incomplete or out of date. Always check the official source, such as your school, your doctor or the authority concerned.
We cannot guarantee that every reminder arrives. Whether and when it appears depends on your device, its operating system and settings, and your network.
We provide heyshary “as is”, to the extent permitted by law. We do not promise that it is free of errors or always available. This does not remove any warranty that the law gives you and that cannot be excluded.
Our total liability to you is limited to the amount you paid for heyshary in the 12 months before the claim, and to at least USD 50. This limit does not apply to gross negligence, intent or personal injury. It also does not apply where the law does not allow such a limit. Some states and provinces do not allow it; to that extent it does not apply to you.
Subscriptions are billed and cancelled through Apple (App Store) or Google (Google Play). You manage and cancel them in your store account. Refunds follow the rules of the store you bought from.
These terms are governed by Austrian law. This does not take away the protection that the mandatory consumer protection laws of your state or province give you. As a consumer, you can bring a claim in the courts where you live, as far as the law allows. There is no fixed venue in Vienna for consumers.
There is no arbitration clause in these terms. You do not give up your right to take part in a class action.
